Term of Use

These Terms of Use (hereinafter referred to as "these Terms") set out the terms of use for the services (hereinafter referred to as "these Services") provided on this website by FUYOH DESIGN Inc. (hereinafter referred to as "our company"). Registered users (hereinafter referred to as "Users") must use the Services in accordance with these Terms.

Article 1 (Application)

These Terms and Conditions shall apply to all relationships between the User and the Company regarding the use of the Service.

Article 2 (User Registration)

Registration will be completed when the person wishing to register applies for registration in the manner specified by our company and our company approves it.

If the Company determines that the applicant for user registration has any of the following reasons, the Company may not approve the application for user registration, and shall not be obligated to disclose the reasons therefor.

• (1) If false information is submitted when applying for user registration
• (2) If the application is from someone who has previously violated these Terms and Conditions.
• (3) Any other reason that the Company determines that registration is inappropriate.

Article 3 (Management of User ID and Password)

Users shall manage their user ID and password for this service at their own responsibility.

Users may not, under any circumstances, transfer or lend their user ID and password to a third party. If a user logs in using a user ID and password combination that matches the registered information, the Company will consider that the user ID is being used by the user who registered it.

Article 4 (Usage Fees and Payment Methods)

In consideration of the use of this service, the user shall pay the usage fee separately determined by our company and displayed on this website by the method specified by our company.

If the User delays payment of the service fee, the User shall pay late payment charges at the rate of 14.6% per annum.

Article 5 (Prohibited matters)

When using this service, users must not engage in the following acts.

• (1) Any act that violates laws, regulations or public order and morals.
• (2) Acts related to criminal activity
• (3) Any act that destroys or interferes with the functioning of our servers or networks
• (4) Any act that may interfere with the operation of our services.
• (5) Collecting or storing personal information about other users
• (6) Impersonating another user
• (7) Any act of directly or indirectly providing benefits to anti-social forces in relation to our services.
• (8) Any other act that the Company deems inappropriate

Article 6 (Suspension of provision of the Service, etc.)

If we determine that any of the following events occur, we may suspend or interrupt the provision of all or part of the Service without prior notice to the User.

• (1) When performing maintenance, inspection, or updates to the computer system related to this service
• (2) When it becomes difficult to provide the Service due to force majeure such as earthquake, lightning, fire, power outage or natural disaster.
• (3) When a computer or communication line is stopped due to an accident.
• (4) Any other reason that the Company determines that it is difficult to provide the Service.

The Company shall not be liable for any disadvantage or damage suffered by the User or a third party due to the suspension or interruption of the provision of the Service, regardless of the reason.

Article 7 (Restrictions on Use and Cancellation of Registration)

In the following cases, we may restrict the User's use of all or part of the Service or cancel the User's registration without prior notice.

• (1) If you violate any provision of these Terms and Conditions
• (2) If it is discovered that any of the registered information is false.
• (3) Any other reason that the Company determines that use of the Service is inappropriate.

The Company shall not be liable for any damages incurred by the User as a result of any actions taken by the Company pursuant to this Article.

Article 8 (Disclaimer)

Our liability for default shall be exempted if the default is not due to our willful misconduct or gross negligence.

Even if the Company is held liable for any reason, the Company shall only be liable for compensation within the scope of damages that may normally occur and, in the case of paid services, within the scope of the fee (or one month's fee in the case of continuous services).

The Company shall not be liable for any transactions, communications, or disputes that arise between users and other users or third parties regarding the Service.

Article 9 (Changes to Service Content, etc.)

The Company may change the content of the Service or discontinue the provision of the Service without notifying the User, and shall not be liable for any damages incurred by the User as a result thereof.

Article 10 (Changes to Terms of Use)

If we deem it necessary, we may change these Terms at any time without notifying the user.

Article 11 (Notification or Contact)

Any notification or communication between the user and the Company shall be made in accordance with the method specified by the Company.

Article 12 (Prohibition of Transfer of Rights and Obligations)

Users may not transfer or pledge their status under the Terms of Use or their rights or obligations under these Terms to a third party without our prior written consent.

Article 13 (Governing Law and Jurisdiction)

The interpretation of these Terms and Conditions shall be governed by Japanese law.

In the event of a dispute regarding the Service, the court with jurisdiction over the location of our head office shall have exclusive jurisdiction.
